1. Acceptance of Terms

By accessing or using the Bushwizard Entries platform at bushwizard.events (“the Platform”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, you may not use the Platform.

These Terms apply to all visitors, registered users, and race organisers who use the Platform. The Platform is operated by Bushwizard Information Technology (“Bushwizard”, “we”, “us”).

2. Eligibility

• You must be at least 18 years old to create an account. Participants under 18 must have a parent or legal guardian create and manage their account and accept these Terms on their behalf.
• You must provide accurate and complete information during registration and keep your account details up to date.

3. Your Account

• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Event Registrations

4.1 Entry Process

Completing the registration flow and accepting the event waiver constitutes your application to enter the event. Your entry is only confirmed upon receipt of full payment. Unpaid entries are held for a limited period and may be cancelled if payment is not received.

4.2 Accuracy of Information

You must provide accurate personal details at registration, including date of birth, gender, and category selection. Providing false information to gain an unfair competitive advantage may result in disqualification and account suspension.

4.3 Waivers & Indemnity

Participation in events is subject to each event's specific waiver and indemnity form, which you must accept as part of the registration flow. By accepting a waiver, you acknowledge the physical risks involved in the event and agree to the indemnity terms set by the race organiser.

4.4 Bib Numbers

Bib numbers are assigned at the time of registration and are non-transferable. You may not transfer your bib number to another participant.

5. Fees, Payment & Refunds

5.1 Entry Fees

Entry fees are set by the individual race organiser and displayed before you complete registration. Early-bird pricing is available where advertised and applies only until the specified deadline.

5.2 Payment Processing

Payments are processed securely via PayToday (Nedbank). Bushwizard does not store your payment card details. By completing payment, you agree to PayToday's terms and conditions.

5.3 Refund Policy

Refund eligibility is determined by the race organiser for each event and will be clearly communicated in the event details. Bushwizard's platform service fee (if any) is non-refundable. In the event an event is cancelled by the organiser, a full refund will be issued.

5.4 Failed Payments

If payment fails or is not completed within the unpaid entry hold period, your entry reservation will be cancelled. You may attempt to re-register subject to availability.

6. Team Entries

• The team captain is responsible for paying the full team entry fee and for sharing the team code with team members.
• Team members must join the team using the team code during their own registration.
• Team compositions may be subject to rules set by the individual race organiser.

7. Results & Data Publication

Race results, including your name, category, finish time, and position, may be published on the Platform and shared with timing partners and race organisers. By participating in an event, you consent to publication of your results.

8. Prohibited Conduct

You agree not to:

• Provide false or misleading information at registration or in your profile.
• Use another person's account or register on behalf of another person without authority.
• Attempt to gain unauthorised access to any part of the Platform or its underlying systems.
• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Scrape, copy, or redistribute Platform content without written permission.
• Interfere with or disrupt the integrity or performance of the Platform.

9. Intellectual Property

All content on the Platform, including logos, text, graphics, and software, is the property of Bushwizard Information Technology or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

10. Limitation of Liability

• Bushwizard acts as a platform intermediary between participants and race organisers. We are not the event organiser and are not responsible for the conduct, safety, or cancellation of any event.
• Bushwizard is not liable for any injury, death, loss, or damage arising from your participation in any event listed on the Platform.
• Our total liability to you for any claim shall not exceed the amount you paid to us (platform fees) in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Platform is provided “as is” and “as available”. We make no warranties, express or implied, that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Namibia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the Namibian courts.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform.
